About these terms

These terms apply to your use of windchaser.ai. WindChaser is run by Zenoo Ltd, a company registered in England and Wales with company number 11093114, whose registered office is c/o Azets, Westpoint, Lynch Wood, Peterborough, Cambridgeshire, PE2 6FZ, United Kingdom. In these terms, "we", "us" and "our" mean Zenoo Ltd.

By using the site you accept these terms. If you do not accept them, please do not use the site. We may update these terms; the date above shows when they last changed, and the version on this page is the one that applies.

How we handle personal data is explained in our privacy notice.

What WindChaser is

WindChaser is a free information site for kitesurfers, windsurfers and wing foilers. It publishes guides to riding spots, wind and weather statistics, forecasts and spot reports. You can use it without an account. Signing in is optional and lets you save things, ask for reports and suggest a change to a spot page or its map. We check each suggestion before a page changes.

The information is guidance, not a safety guarantee

We work to make the information on WindChaser accurate, but we cannot guarantee that it is complete, correct or up to date. In particular:

• Forecasts are predictions and can be wrong. Conditions at a spot can change quickly and differ from the forecast.
• Wind and weather statistics describe past conditions. Some figures are produced by models rather than measured at the spot.
• Spot guides, hazards, access and local rules are summaries. Rules, restrictions and hazards change, and a guide may not show the latest position.
• Some content is researched with the help of AI tools, and errors can remain.

Do not rely on WindChaser as your only source of information when deciding whether, where or when to go on the water.

Your safety is your responsibility

Wind sports carry a risk of serious injury and death. You alone decide whether to ride, and you are responsible for your own safety and for the safety of others affected by what you do. Before and during any session you should:

• check the actual conditions at the spot on the day, including wind, waves, tides and currents;
• check and follow the local rules, restrictions, permits and any instructions from the authorities, lifeguards, harbour masters or local clubs;
• know the hazards at the spot and where you may and may not launch and ride;
• ride only in conditions within your ability and experience, with equipment that is suitable and in good condition;
• take instruction from a qualified school where you are learning or unfamiliar with a spot.

If what you see at the spot differs from what WindChaser shows, trust the conditions in front of you and the local rules. We would also like to hear about it, so we can correct the guide.

Your account

If you sign in, keep access to your email account secure, because anyone who can read your email can sign in as you. Give us accurate information. You can ask us to close your account at any time by writing to hello@windchaser.ai.

Using the site properly

When you use WindChaser, you must not:

• break the law, or use the site to help anyone else break it;
• try to gain access to accounts, systems or data that are not yours;
• interfere with the site, overload it, or introduce anything harmful such as malware;
• copy or collect content from the site in bulk by automated means, except through search engines and our published files for them;
• upload or post anything unlawful, offensive, misleading, or that you do not have the right to share, including in your profile or in a correction;
• send suggestions that are false, copied or abusive;
• pretend to be someone else.

We may remove content or suspend or close an account that breaks these terms. Where it is reasonable, we will tell you why.

Who owns the content

The text, design, compilations of data and software on WindChaser belong to Zenoo Ltd or to the people and organisations who license them to us. You may view the site, share links to it, and print or save pages for your own personal, non-commercial use. Any other use needs our written permission, unless the law allows it.

Photographs belong to their photographers or the sources they come from. Where a photograph carries a credit, the credit names its owner and, where there is one, its licence. Please do not reuse a photograph without checking its licence with its owner. Our wind statistics are calculated from Open-Meteo weather data, which is licensed under CC BY 4.0.

To check those figures, we record readings from open weather stations near some spots, including stations of the OpenWindMap network, used under its Community Licence. Wind data © contributors of the OpenWindMap wind network, openwindmap.org.

If you believe something on WindChaser uses your work without permission, or a credit is wrong, write to hello@windchaser.ai and we will look into it promptly.

Suggestions you send us

You must be 13 or over to sign in or send a suggestion. A suggestion does not change a page: we decide whether and how a page changes, and we write any new wording ourselves.

When you send a suggestion you give us a non-exclusive, worldwide, royalty-free and perpetual licence to use, adapt and act on the information in it to check and improve WindChaser, including through service providers who work for us. We may pass this licence to anyone who takes over WindChaser.

You promise that what you send comes from your own first-hand knowledge or from a source you may share; that it is not copied from other maps, guides or apps, including Google Maps; that you will tell us if you run or work for a business you comment on; that it contains no one else's personal details; and that you act in good faith.

You can withdraw a suggestion while it waits and ask us to delete your suggestions at any time. Once a page has changed, the new wording is ours. We limit how many suggestions an account can send, and we may refuse suggestions from, or suspend, an account that misuses this.

A position you mark on our map is a report to us, not a map we publish. A pin shown to you as pending has not been checked. Do not rely on it.

Anything else you give us, such as a profile photo or an answer through a spot guide review link, stays yours. You give us permission to store and use it to run your account and to correct our guides, you confirm you have the right to share it, and you can ask us to remove it at any time.

Links to other websites

WindChaser links to other websites, such as official rules, local clubs, maps and schools. We do not control them and are not responsible for their content or how they handle your data.

Availability of the site

WindChaser is provided free of charge and as it is. We may change, suspend or withdraw any part of it at any time, and we do not promise that it will always be available or free of errors.

Our liability to you

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law does not allow us to limit or exclude. Nothing in these terms affects your statutory rights as a consumer.

Subject to that, and as far as the law allows:

• we are not liable for any loss or damage arising from your reliance on information on WindChaser, or from your decision to take part in wind sports at any spot;
• we are not liable for any business loss, such as loss of profit, revenue or business opportunity;
• we are not liable for loss that was not reasonably foreseeable when you used the site;
• because the site is free, our total liability to you for all other claims is limited to £100.

Law and courts

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute about them. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts where you live.
